Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and AskEmbed ("we", "us", or "our") governing your access to and use of https://askembed.com and the associated embedded widget (the "Service"). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of a company, you represent that you have authority to bind that company.

The Service

AskEmbed lets you build AI chatbots that answer questions based on content you provide - uploaded files or ingested URLs - and embed them on your websites with a single line of code. Answers are generated from your content, cite their sources, and refuse to answer when no confident answer exists. The Service also includes free public tools that run without an account (an FAQ generator and chatbot demos); these Terms apply to them in the same way.

Accounts

You need an account to use the Service. You must provide accurate information, keep your credentials secure, and are responsible for all activity under your account. You must be at least 13 years old (16 in the European Economic Area) to create an account.

Let us know promptly at our contact email if you suspect unauthorized access to your account.

Plans, Quotas, and Billing

The Service offers the plans and quotas shown on our pricing page. Quotas (chatbots, messages, indexed pages, crawl size) are enforced automatically and may change with the published plan definitions.

  • Payments are processed by Creem, our Merchant of Record. Creem handles checkout, taxes, and invoicing; we do not store your payment card details.
  • Subscriptions renew automatically (monthly or yearly) until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period and you retain access until then.
  • Mid-cycle downgrades to a lower-tier plan are not supported; you can switch once your current period ends.
  • Except where required by applicable law, fees already paid are non-refundable. Disputed charges should be raised with us first via the contact email below.
  • We may change plan prices for future billing periods and will notify you in advance of any change affecting your renewal.

Your Content and Responsibilities

"Your Content" means the documents you upload, the URLs you ask us to ingest, your chatbot configuration, and the conversations collected through your chatbots. You retain ownership of Your Content.

To provide the Service, you grant us a limited, worldwide, non-exclusive license to host, copy, index, and process Your Content (including running it through AI models for embeddings and answer generation). This license ends when Your Content is deleted from the Service.

You are responsible for Your Content and represent that:

  • You have the rights needed to upload and process the documents and URLs you give us. Website crawling is performed only on URLs you submit, respects the target site's robots.txt, and it is your responsibility to have permission to ingest any third-party site.
  • Your Content and your use of the chatbots comply with applicable law and these Terms, including any privacy obligations you have toward your own website visitors.

Acceptable Use

You may use the Service only for lawful purposes. You must not, and must not allow your end users to:

  • Upload or ingest content that is unlawful, infringing, defamatory, or that distributes malware or other harmful code.
  • Use the Service to harass, defraud, or harm anyone, or to generate content that does so.
  • Circumvent plan quotas (for example by creating multiple accounts) or resell access to the Service without our written agreement.
  • Interfere with or probe the Service's infrastructure, or reverse engineer the widget or API except as permitted by law.

Features marketed as unlimited are subject to fair use. We may throttle or suspend usage that materially exceeds normal patterns or degrades the Service for others.

AI Output

Answers are generated by AI models based on Your Content. They may be inaccurate, incomplete, or outdated despite our "refuse when unsure" design. You are responsible for reviewing output and deciding how to present it to your end users.

Chatbot answers do not constitute legal, medical, financial, or other professional advice, and neither we nor our AI providers are liable for decisions made based on them.

Availability and Changes to the Service

The Service runs on edge infrastructure and we aim for high availability, but we do not promise uninterrupted or error-free operation, scheduled maintenance excepted. We may add, modify, or discontinue features of the Service; for material reductions to a paid plan we will provide notice before your next renewal.

Intellectual Property

The Service - including the website, dashboard, widget, and software - is owned by AskEmbed and its licensors. These Terms do not grant you any rights in the Service beyond the right to use it as intended, and you may not remove or obscure our branding except where the plan you purchased includes that option (the "Powered by AskEmbed" watermark).

“AskEmbed” and related marks are our trademarks. You may not use them without permission, other than to reference the Service truthfully.

Termination

You may stop using the Service and delete your account at any time by contacting us. Deleting a chatbot immediately purges its files, embeddings, and conversations.

We may suspend or terminate your account if you materially breach these Terms, create risk or legal exposure for us or others, or fail to pay amounts due - with prior notice where practicable.

Upon termination, your right to use the Service ends, and Your Content will be deleted as described in our Privacy Policy. Sections that by their nature should survive (including payment obligations, disclaimers, and liability limits) survive termination.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate.

Limitation of Liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, or consequential damages, or for lost profits or data, even if advised of the possibility.

Our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the twelve months preceding the claim. Some jurisdictions do not allow certain limitations, in which case they apply to the extent permitted.

Disputes

If you have a dispute with us, please contact support@askembed.com first - most issues can be resolved informally. Anything unresolved will be brought exclusively in the courts of competent jurisdiction where the operator of AskEmbed is established.

Changes to These Terms

We may update these Terms as the Service evolves. The "Effective date" at the top shows the latest revision, and material changes will be announced by email or in-product at least 7 days before taking effect. Continuing to use the Service after that means you accept the updated Terms.
